Special Conditions of Sale

The present terms of sale are concluded on one hand by the company HISPANOA, S.A.S. with a capital of 868,988.00 euros, whose registered office is at ZA de Putillenea 6 rue Poutillenea 64122, URRUGNE, registered at the Bayonne Trade and Companies Registry under the number 528 366 016 and at the Register of Travel and Holiday Operators under the number IM064110003, hereinafter referred to as "HISPANOA" and on the other hand, by any natural or legal person wishing to proceed with a purchase via the "HISPANOA" website online, by telephone, through an intermediary or partner, hereinafter referred to as "the buyer".

 

Subject

The present conditions of sale aim to define the contractual relations between HISPANOA and the buyer and the conditions applicable to any purchase made through the HISPANOA merchant site, whether the buyer is a professional or an individual.

The acquisition of a good or service through this site implies an unconditional acceptance by the buyer of these terms of sale. These terms of sale will prevail over all other general or specific conditions not expressly approved by HISPANOA. HISPANOA reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the buyer's order.

Pre-contractual Information

Before the conclusion of the reservation contract, you will find on the internet all the information about prices, dates, and the elements constituting the stay such as:

Location of the accommodation, level of comfort, main characteristics according to HISPANOA criteria and possible country usages, amount or percentage and payment schedule, cancellation conditions...

The apartments and houses offered are entered according to information collected several months before, changes may have occurred before your reservation, updated as and when in our computer system. The description and the invoice/confirmation of reservation are therefore the only contractual elements of your reservation. The data mentioned on the internet in the price grids are valid at the date of your booking and replace previous publications.

When you make a Reservation, you accept the applicable conditions as they are displayed in the booking process. The cancellation conditions of each Service Provider and all other conditions (concerning age conditions, deposits/security deposits, supplements for Group Reservations, extra beds, breakfast, pets, etc.) are accessible on our Platform: on the Service Provider's information pages, during the booking process, in the clauses and in the confirmation email.

 

1. Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the HISPANOA site.

These products and services are offered within the limits of available stocks.

Each product is accompanied by a description established by the supplier; for some of them, labeled DF, the buyer can have access to the supplier's documentation.

The photographs in the catalog are as faithful as possible but cannot ensure a perfect similarity with the offered product, especially with regard to colors.

2. Geographical area

The sale of products and services presented on the HISPANOA site is reserved for buyers who reside in France, the DOM-TOM, or Monaco and for deliveries required in these geographical areas.

 

3. Prices

The prices listed in the catalog are prices in Euros taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services. HISPANOA reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog the day of the order will be the only one applicable to the buyer. The prices indicated include (or exclude) the processing fees of orders, transport, and delivery as long as they take place in the geographical areas set above.

 

4. Orders

The buyer, who wishes to buy a product or service must:

  • Fill in the identification form on which he will indicate all the requested details or give his customer number if he has one;
  • Fill in the online order form giving all the references of the selected products or services;
  • Validate the order after having checked it;
  • Make the payment as provided;
  • Confirm the order and payment.

The confirmation of the order implies acceptance of these conditions of sale, the recognition of having perfect knowledge of them, and the renunciation of taking advantage of one's own purchase conditions or other conditions. All the data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will be worth signing and accepting the operations carried out. The seller will communicate by email confirmation of the registered order.

 

5. Payment

The price is due at the time of order. Payments will be made by credit card; they will be carried out through the secure system that uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third parties can become aware of it during transport on the network.

The buyer's account will only be debited when the available products or services are shipped and only for the amount of the products or services sent or downloaded. At the buyer's request, they will be sent a paper invoice showing the VAT.

 

6. Withdrawal

Buyers, non-professional individuals, benefit from a withdrawal period of fourteen days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for return shipping costs.

 

7. Delivery

Deliveries are made to the address specified in the order form which can only be in the agreed geographical area. The risks are borne by the purchaser from the moment the products have left the premises of HISPANOA. In case of damage during transportation, a reasoned protest must be made to the carrier within three days of delivery. Delivery times are only given as an indication; if they exceed thirty days from the order, the sales contract may be canceled and the buyer reimbursed.

 

8. Warranty

All products supplied by the seller benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-compliance of a sold product, it can be returned to the seller who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by post to the following address: ZA de Putillenea 6 rue Poutillenea 64122, URRUGNE, within thirty days of delivery.

 

9. Responsibility

The seller, in the process of selling online, is only bound by an obligation of means; its liability cannot be held liable for damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service breakdown, or other unintended problems.

The data contained on the site is as accurate as possible and the site is periodically updated, but may contain inaccuracies, omissions, or deficiencies. If you notice a deficiency, error, or what appears to be a malfunction, please report it by email, describing the problem as accurately as possible (page causing the problem, triggering action, type of computer and browser used, etc.).

 

10. Intellectual property

All elements of the HISPANOA site are and remain the intellectual and exclusive property of HISPANOA. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.

 

11. Personal data

In accordance with the law relating to data, files, and freedoms of January 6, 1978, nominative information concerning buyers may be subject to automated processing. HISPANOA reserves the right to collect information on purchasers including by using cookies, and, if it wishes, to transmit to commercial partners the collected information. Buyers may object to the disclosure of their details by notifying HISPANOA. Similarly, users have a right to access and correct data concerning them, according to the law of January 6, 1978.

The automated processing of information, including the management of users' email addresses, has been declared to the CNIL on [date].

 

12. Archiving - Proof

HISPANOA will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The computerized registers of HISPANOA will be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties.

13. Dispute Resolution

These online sales conditions are subject to French law. In the event of litigation, jurisdiction is assigned to the competent courts of Paris, notwithstanding plurality of defendants or appeal in guarantee.

 

14. Conditions of Sale

These conditions of sale are intended to define the contractual relationship between HISPANOA and the buyer and the conditions applicable to any purchase made through the HISPANOA merchant site, whether the buyer is professional or consumer. The acquisition of a good or service through this site implies an unreserved acceptance by the buyer of these conditions of sale.

These conditions of sale will prevail over any other general or specific conditions not expressly approved by HISPANOA. HISPANOA reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

 

15. Legal Information

The personal information collected for the purpose of distance selling is mandatory, this information being essential for the processing and delivery of orders, the preparation of invoices, and warranty contracts. The lack of information results in the non-validation of the order.

In accordance with the law "Informatique et Libertés", the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL). The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification, and deletion of the data that concerns them, which they can exercise with HISPANOA. Moreover, HISPANOA undertakes not to communicate, free of charge or with counterpart, the contact details of its customers to a third party.
